Özet: Tez, giriş kısmı ve dört bölümden oluşmaktadır. Giriş kısmında, çalışmanın önemi, amacı, sınırlılıkları hakkında bilgi verilmiştir. Birinci bölümde, ehliyet konusunun İslâm hukukundaki mahiyetine, vücub ve eda ehliyeti kavramlarına, kişide ehliyetin tam ve eksik olması ile ilgili konulara değinilmiştir. İkinci bölümde ise, kişinin, cenin halinden itibaren, hayatın çeşitli evreleri olan doğum, çocukluk, ergenlik ve rüşd çağı da dahil olmak üzere, hangi şartlarda vücub ve eda ehliyetine sahip olup olmadığına değinilerek çeşitli durumları incelenmiştir. Üçüncü bölümde ise, ehliyeti daraltan ve ortadan kaldıran sebepler başlığı altında, çocuk olma, akıl hastalığı, uyku, bayılma, unutma, kölelik, ölüm hastalığı, hayz ve nifas hali gibi semavi ehliyet arızalarıyla; bilmezlik, sarhoşluk, hezl, sefeh, sefer ve ikrah gibi müktesep ehliyet arızaları, Hanefî, Şâfiî, Hanbelî ve Malikî mezhebi görüşleri çerçevesinde incelenmiştir. Tez konumuzun esasını teşkil eden dördüncü bölümde ise, başlıklar halinde, semavi ve müktesep ehliyet arızalarının, nikâh akdi ve talâk üzerindeki etkileri ele alınmıştır. Bu bölümde ehliyet arızalarının, nikâh akdi ve talâk üzerindeki etkilerinin, mezheplere göre hükümleri ele alınmış; klasik dönem İslâm âlimleri ile günümüz İslâm âlimlerinin konuyla ilgili görüşlerine yer verilmiştir. Konular incelenirken Hanefî, Şâfiî, Mâlikî ve Hanbeli mezhebi görüşleri çerçevesinde kalınmaya dikkat edilmiştir. Çalışmada mümkün olduğunca mezheplerde kabul gören görüşlere yer verilmeye çalışılmıştır. Çalışmada ayrıca günümüz problemlerinden ehliyet arızaları başlığı altında incelenmesi mümkün olabilecek türden olan, internet bağımlılığı, sanal sosyal ortamlarda etkin ve saygın olma güdüsü ile oyun bağımlılığı vb. durumlara da kısaca değinilmiştir.

Abstract:The thesis consists of an introduction part and four chapters. In the introduction part, information is given about the importance, purpose and limitations of the study. In the first chapter, the nature of capacity in Islamic law, the concepts of ahliyyat al-wujub and capacity to act, and the issues related to the integrity and deficiency of capacity of a person are mentioned. In the second chapter, various situations of a person starting from the fetal state, including birth, childhood, adolescence and juvenile age which are various stages of the life are examined by referring to the conditions under which he has ahliyyat al-wujub and the capacity to act. In the third chapter, under the title of reasons that narrow and eliminate the capacity, the malfunctions of celestial capacity such as being a child, mental illnesses, sleeping, fainting, forgetting, slavery, death sickness, menstruation and puberty; the malfunctions of acquired capacity such as ignorance, drunkenness, frivolousness, profligacy, expedition and duress have been examined within the framework of the views of the Hanafi, Shafii, Hanbali and Maliki sects. In the fourth chapter, which constitutes the basis of our thesis topic, the effects of celestial and acquired capacity malfunctions on the marriage contract and talaq are discussed under headings. In this section, the effects of capacity malfunctions on the marriage contract and talaq are discussed according to the sects and the views of classical period Islamic scholars and contemporary Islamic scholars on the subject are included. While examining the subjects, it is made a point of staying within the framework of the views of Hanafi, Shafii, Maliki and Hanbali sect scholars. In the study, it has been tried to include the views accepted in the sects as much as possible. In addition to these, the types of situations that can be examined under the title of capacity malfunctions among today's problems such as internet addiction, the motivation to be active and respected in virtual social environments and game addiction are briefly mentioned in the study.
